Physician behaviour, malpractice risk and defensive medicine: an investigation of cesarean deliveries

Summary: The study explores the impact of patient conditions on physicians' use of cesarean sections as defensive medicine, using natural experiments arising out of Oregon court decisions. The results suggest that when medical exigencies dictate a c-section, tort laws have no impact, while evidence of defensive medicine is found when physicians have discretion in decision making. The study indicates that not accounting for heterogeneous physician reactions to tort laws may lead to biased estimates.
