How can a new UN ocean treaty change the course of capacity building?

Harriet Harden-Davies et al.

Summary: Capacity building is crucial for the conservation and sustainable use of marine biological diversity beyond national jurisdiction. Strengthening the international legal framework, funding, information-sharing, monitoring and decision-making is essential to address the persisting gaps in scientific capacity. The upcoming negotiations for the BBNJ Agreement present a critical opportunity to secure effective and equitable outcomes for the global ocean commons.

Regional fisheries management organizations and the new biodiversity agreement: Challenge or opportunity?

Bianca Haas et al.

Summary: In 2018, the international community initiated formal intergovernmental negotiations on a new legally binding instrument for the protection of marine biodiversity beyond national jurisdiction. The goal is to protect marine biodiversity for a sustainable future by ensuring cooperation between different organizations and agreements, while also respecting existing legal instruments and mandates of regional and sectoral marine governance organizations.

The binding force of the BBNJ agreement on third parties

Deyi Ma et al.

Summary: With the sustained progress of the UNGA in the field of BBNJ, a draft of an international legally binding instrument has begun to take shape, but there are wide divergences between governments and lack of binding force on third parties. Approaches to strengthen this binding force through customary international law and soft law are theoretically feasible but unlikely to impose substantial legal restraint on third parties. A new perspective from UNCLOS is proposed to improve the integrity of the BBNJ Agreement through both internal and external pathways.

Transboundary cooperation and mechanisms for Maritime Spatial Planning implementation. SIMNORAT project

M. Gomez-Ballesteros et al.

Summary: Maritime Spatial Planning (MSP) is becoming increasingly important for the governance of seas and oceans, aiming to reverse environmental degradation and promote sustainable use of marine resources. In Europe, coastal Member States are required to develop maritime spatial plans by 31st March 2021, with the support of existing tools and guidelines, such as the SIMNORAT project co-funded by the EC - DG Maritime Affairs and Fisheries.

The complex relationships between marine protected areas and marine spatial planning: Towards an analytical framework

Brice Trouillet et al.

Summary: Systems of Marine Spatial Planning (MSP) and Marine Protected Areas (MPAs) are often developed in parallel, but lack integration due to the longer history and established institutional frameworks of marine conservation. However, there are various options available to link these processes more closely together.
