The goal is to protect marine biodiversity for a sustainable future by ensuring cooperation between different organizations and agreements, while also respecting existing legal instruments and mandates of regional and sectoral marine governance organizations.

The binding force of the BBNJ agreement on third parties

Summary: With the sustained progress of the UNGA in the field of BBNJ, a draft of an international legally binding instrument has begun to take shape, but there are wide divergences between governments and lack of binding force on third parties. Approaches to strengthen this binding force through customary international law and soft law are theoretically feasible but unlikely to impose substantial legal restraint on third parties. A new perspective from UNCLOS is proposed to improve the integrity of the BBNJ Agreement through both internal and external pathways.

Summary: Maritime Spatial Planning (MSP) is becoming increasingly important for the governance of seas and oceans, aiming to reverse environmental degradation and promote sustainable use of marine resources. In Europe, coastal Member States are required to develop maritime spatial plans by 31st March 2021, with the support of existing tools and guidelines, such as the SIMNORAT project co-funded by the EC - DG Maritime Affairs and Fisheries.
