Free Trade, Environment, Agriculture, and Plurilateral Treaties: The Ambivalent Example of Mercosur, CETA, and the EU-Vietnam Free Trade Agreement

Katharine Heyl et al.

Summary: This article assesses recent free trade agreements negotiated by the European Union to determine their effectiveness in upholding environmental standards in line with global goals and promoting environmental pioneering policies. The analysis finds that while some mandatory standards have been established, overall, the agreements lack a comprehensive legal framework and have weak dispute settlement mechanisms. Provisions on regulatory cooperation and investor-state dispute settlement may negatively impact decision-making processes and discourage ecological pioneering policies in the trading Parties.
