Summary: The Early Warning System (EWS) aims for national Parliaments to monitor the subsidiarity principle, but also addresses substantive issues. Economic similarity between Parliaments is the strongest factor associated with the co-issuance of Reasoned Opinions (ROs), suggesting that proposals with economic impacts are more likely to trigger opposition.

Summary: The control of subsidiarity by national parliaments in the Area of Freedom, Security and Justice is influenced not only by their institutional strength in EU affairs, but also by the institutional evolution and material scope of EU proposals. When faced with EU legislation that threatens Member States' legal traditions and State powers, national parliaments tend to rely on a narrow legal interpretation of subsidiarity. However, when dealing with politically sensitive and contentious issues, a more political approach to subsidiarity control is adopted.
