Substance and subsidiarity: the economic dimension of conflict in the early warning system

Martijn Huysmans et al.

Summary: The Early Warning System (EWS) aims for national Parliaments to monitor the subsidiarity principle, but also addresses substantive issues. From Legal to Political Reasoning: National Parliaments' Use of Reasoned Opinions in the Area of Freedom, Security and Justice*

Angela Tacea

Summary: The control of subsidiarity by national parliaments in the Area of Freedom, Security and Justice is influenced not only by their institutional strength in EU affairs, but also by the institutional evolution and material scope of EU proposals. When faced with EU legislation that threatens Member States' legal traditions and State powers, national parliaments tend to rely on a narrow legal interpretation of subsidiarity. However, when dealing with politically sensitive and contentious issues, a more political approach to subsidiarity control is adopted.
