Property rights in informal settlements

Marco Aurelio Zazyki et al.

Summary: This article provides a systematic review of the literature and future research directions on property rights in informal settlements. The study focuses on the Goal 11 of the United Nations' 2030 Agenda, which aims to make cities and human settlements safe, resilient, and sustainable. By analyzing 119 articles published in the past 58 years, the study identifies studies on property law in formal tenure structures and the significance of tenure systems formed by customs and beliefs in informal settlements. The research suggests future possibilities by applying the New Institutional Economics literature and exploring the perception of security of tenure. This study offers insights and strategies for governments in developing countries to strengthen secure property rights, distributive justice, and inclusive urban (re)development in informal settlements.

Unraveling the self-made city: The spatial impact of informal real estate markets in informal settlements

Josje Bouwmeester et al.

Summary: The study argues that there are similarities in the property rights regimes of formal and informal real estate markets, but conflicts arise due to differences in legitimacy. The formal market sees the informal market as illegitimate, while the informal market views the formal market as exclusionary. Further research in spatial planning is recommended to better understand formal-informal interactions.
